Personal Data Protection Act ("PDPA") Compliance. To the extent that any data or information belonging to Client is personal data within the meaning of the PDPA:

(a) PEOPLE360 will process such data and information only in accordance with Client's instructions;

(b) PEOPLE360 will not transmit such data and information to a country or territory outside Singapore without Client's prior express written consent; and

(c) PEOPLE360 will take such technical and organisational measures against unauthorised or unlawful processing of such data and information and against accidental loss or destruction of, or damage to, such data and information as are appropriate.

To the extent that any data or information belonging to PEOPLE360 or candidate is personal data within the meaning of the PDPA:

(i) Client will process such data and information only in accordance with the provisions of the PDPA;

(ii) Client will not transmit such data and information to a country or territory outside Singapore without the prior express written consent of candidate and PEOPLE360; and

(iii) Client will take such technical and organisational measures against unauthorised or unlawful processing of such data and information and against accidental loss or destruction of, or damage to, such data and information as are appropriate.

Confidentiality. We will keep confidential all information we receive from you regarding your business and affairs, except where:

(a) we are instructed by you to disclose,

(b) disclosure is to our affiliates and advisors,

(c) the information is already in the public domain,

(d) we are required by applicable laws to disclose, or

(e)for insurance notification purposes.
